Support and protection for Anas Al Mustafà. Letter sent to Ms Alice Mogwe (President FIDH - International Federation for Human Rights) - 02/12/2020

Dear President,

I am writing to you at this time to seek your assistance in the situation of Anas Al Mustafà.

Mr. Anas Al Mustafà, a refugee in Turkey, has been a volunteer in Konya since 2016 to help Syrian refugee families fleeing the war who make it to Turkey.

Mr. Anas Al Mustafà started the “A friend Indeed” Non-Profit Association and assisted more than 175 very poor families and about 400 orphaned children. Anas has collaborated with the Italian organizations “Crescere insieme” and “Mani di Pace” as well as with the Romanian organization “Help and care trust”.

On May 15, 2020, the Turkish police broke into his home. Anas was arrested and could not defend himself from the charges. The policemen tore up the original Turkish document that legitimized him to reside in Konya and the photocopy of the Syrian one he kept in his wallet. The Turkish police jailers said he was being held in prison to check the regularity of the residence cards. One evening Anas and other Syrian prisoners were forcibly forced to sign a document. The Turkish police tore up all their documents and with a van they took Anas and the other prisoners to a Syrian prison in an isolation center in Idilib. For several months Anas was held captive in Syria but managed to escape.

I ask for support and protection for Anas Al Mustafà, who is currently in Turkey but risks a new arrest and deportation to Syria.

Dear Mrs. Mariacarmela Ribecco,
Thank you for your letter of 31 August 2020 to Commissioners Ylva Johansson were you express your concern regarding the death of migrants in the Mediterranean sea and call for an expansion of humanitarian corridors to the European Union.
The European Commission shares your concerns and strongly regrets any loss of life in the Mediterranean. To save lives at sea and prevent dangerous journeys, the Commission wishes to ensure that vulnerable refugees can find shelter in the EU without having to resort to migrant smuggling networks. The Commission is fully supporting the expansion of safe and legal pathways to the EU, such as resettlement, humanitarian admission and complementary pathways of admission for persons in need of international protection.
The European Commission Recommendation on legal pathways to protection in the EU, issued on 23 September 2020, calls on Member States to continue and expand resettlement efforts and develop humanitarian admission and other forms of complementary pathways for persons in need of international protection, with the overarching objective of increasing the overall number of places for legal and safe admission.
More than 70,000 persons have already been resettled in the EU since 2015 and for 2020, Member States pledged collectively 30 000 places, for which the implementation period has been extended until the end of 2021 due to the pandemic. In addition, member states have developed at the national level, humanitarian admission programmes, such as humanitarian corridors in Italy and France. Those programmes have provided additional safe places of admission to the EU and the EU encourages their expansion.
To address the specific situation of refugees stranded in Libya, especially those in the dentention centers, the EU is committed to provide life-saving assistance to the most vulnerable refugees by funding humanitarian evacuations from Libya to the Emergency Transt Mechanisms (ETM) in Niger and Rwanda. From those countries, UNHCR in collaboration with Member States and other resettlement states are seeking durable solutions for those refugees, mostly through resettlement.
Allow me to give you some recent data on resettlement and humanitarian evacuations via the Emergency Transit Mechanisms in Niger and Rwanda:
 On 29 November 2020, 51 persons of concern left for resettlement to Sweden;
 As of 23 November, 5,929 persons have been evacuated from Libya to third countries since 2017, including 1,437 persons through direct resettlement from Libya; 808 persons for humanitarian evacuations to Italy; 3,318 persons to ETM Niger; and 385 persons to ETM Rwanda.
 On 19 November, UNHCR operated an evacuation flight of 79 persons to ETM in Rwanda. The composition of the evacuees was as follows: 33 Eritreans, 4 Somali and 42 Sudanese individuals, including four children;
 On 15 October, UNHCR operated an evacuation flight of 153 vulnerable refugees and asylum-seekers out of Libya to the Emergency Transit Mechanism in Niger. This UNHCR-chartered flight marks the resumption of life-saving evacuations from Libya, ending a seven-month long suspension. A further humanitarian evacuation flight to Niger is planned to take place before the end of the year.
Resettlement has been and will continue to focus on providing solutions to the dire situation of refugees along the Central Mediterranean route.

Dear Ms Ribecco,

Thank you for your letter to Commissioner Johansson of 18 August, in which you share your concerns regarding the situation of migrants in the Greek islands, especially of Lesvos. The Commission is fully aware of the challenges in the Greek hotspots and supports the Greek authorities to manage migration in respect of the EU values and of human rights.

Since the outbreak of the COVID-19 pandemic, the Commission has promptly supported the Greek authorities in setting up and implementing an emergency support plan to limit the risks of COVID-19 in the Reception and Identification Centres (RICs).

We also support and coordinate the voluntary relocations of unaccompanied minors, sick children with their family, refugees and vulnerable asylum seekers from Greece to other Member States, including Germany, and Norway, Switzerland and Iceland, with so far more than 1 600 transferred persons.

In light of the fire that destroyed the RIC of Moria on Lesvos in September, the Commission granted further emergency assistance to support the Greek authorities in providing adequate shelter to the people affected and transfer vulnerable persons, and notably unaccompanied minors, to the mainland.

In addition to this immediate support, the Commission established a European Task Force to improve the reception conditions on the island in a durable way to ensure that, in future, there will be no more situation like in Moria. The taskforce which is composed by relevant Commission services, EU Agencies and Member States, will help making sure that migration is managed effectively and in compliance with EU law and standards, especially as concerns adequate living conditions and faster procedures.

With the aim to find sustainable solutions, including improved legal pathways, the European Commission recently launched the New Pact on Migration and Asylum, based on solidarity and a fair share of responsibility among Member States. You can find here more information on the Pact and on the new solidarity mechanism envisaged in it.

Estimada Sra. Ribecco:
Nos ponemos en contacto con usted en respuesta al nuevo escrito que ha remitido a la Presidencia del Gobierno, en el que traslada sus reflexiones sobre la situación de las personas refugiadas que se vieron afectadas por el incendio ocurrido en el campo de refugiados de Moria, en la isla de Lesbos, que hemos leído con interés.
En este sentido, el Gobierno considera necesario dar una respuesta europea a un drama que ocurre dentro de las fronteras de este continente, en nuestro suelo, y al que tenemos que responder de manera común con principios de responsabilidad, justicia y solidaridad, atendiendo a todas las dimensiones de la cuestión.
Por otro lado, nos gustaría subrayar que España ha demostrado que es posible combinar una política migratoria responsable con una respuesta solidaria y acorde a los valores europeos. A nivel europeo seguimos trabajando para dejar de dar respuestas ad hoc e institucionalizar y sistematizar el reparto de refugiados. Esa es la clave que nos permitirá afrontar conjuntamente un problema que es eminentemente comunitario.

Dear Ms Ribecco,
Thank you for your message addressed to President Sauli Niinistö concerning the destroyed Moria refugee camp in Greece.
Finland has sent material assistance to Greece through the European Union Civil Protection Mechanism as part of the European Union’s joint assistance mission. The Finnish Ministry of the Interior has cooperated with the Finnish Red Cross in the procurement and transport of supplies.
Finland also decided to assist Greece by receiving 11 unaccompanied minor asylum seekers from the Moria camp destroyed by fire. In the past spring, the Finnish Government decided to receive 175 particularly vulnerable asylum seekers from the Mediterranean region. The reception of these 11 underage asylum seekers is part of the implementation of this decision.
The President carries out only the duties stated in the Constitution of Finland or specifically stated in another Act. Immigration affairs do not fall within the scope of the President’s tasks and powers. Immigration affairs in Finland are processed and decided upon by the competent authorities pursuant to the relevant legislation.
